BUYER - TERMS and CONDITIONS

This agreement is a legal document which sets out your rights and obligations, in relation to the services offered by us through Rogue Gene Gallery, owned and operated by Andrea Pannell and Robert Kirbyson.

By using our website in any way, or by buying from our artists, you agree to be bound by the terms and conditions stated.

No person under the age of 18 years may purchase goods from this site.

Rogue Gene Gallery will not enter into any dialogue between buyer and seller (the artist) and offers only free exhibition space to self representing artists. All our artists are carefully selected to ensure a variety of high quality original artworks are offered to the buyer. All artwork sizes should be accurate to within 10 cm in both height and width. Images shown on screen should be as accurate as possible to the original artwork. We reserve the right to remove unsuitable images from this website at any time.

Rogue Gene Gallery is a company registered in England, and every sale shall be deemed to be performed in England; English law shall govern each transaction, including (without limitation) all contractual and other relationships, which arise as a result of such sales. You and we submit to the exclusive jurisdiction of the English courts in relation to any disputes arising out of any sale.

Ordering and Shipping
When you agree to purchase an artwork through Rogue Gene Gallery you are bound to each individual artists ordering and dispatch/shipping terms as stated in their gallery. All our artists accept Paypal and/or cheques drawn from a UK bank account as a form of payment. Goods are dispatched directly from the artist concerned after funds have cleared. All prices shown on this site are in £GBP pounds. Please contact the artist concerned for precise delivery/shipping costs before using Paypal unless otherwise stated.

Returns and Refunds
In accordance with Rogue Gene Gallery's 14 day refund policy, if are not completely happy with the purchase you have made, for whatever reason, then you may return the artwork in original condition to the artist concerned within 14 days of receiving the work for a refund on the price of the item. Return delivery costs will not be refunded. You are not legally entitled to a refund for an item which has been created specially for you such as a personalised commission.

Damaged/Lost Artworks
The above is Rogue Gene Gallery's standard returns and refunds policy in situations where the buyer is unhappy with his/her delivered artwork. All our artists package their artworks carefully. Loss or damage in transit is rare but we advise that all artworks be sent with proof of postage, proof of receipt and adequate insurance. Please check the condition of  your artwork when delivered and notify the artist concerned within 24 hours if damage is discovered. Please keep all original packaging and take digital photographs if possible, as this may be required to make a claim against the carrier. The artist concerned will resolve your matter to your satisfaction as soon as possible. 

Corrections
The descriptions of goods and services included in the Rogue Gene Gallery site are accurate to the best of our knowledge. We do our best to correct errors or omissions as soon as we are aware of them. However, you should be aware of the limitations of digital photography and that the colours and appearance of artworks shown on screen may vary slightly from the original artwork.

Copyright
The images and designs used on the Rogue Gene Gallery website are the property of Rogue Gene and/or their respective copyright owners (eg. the artist). All images displayed by our artists are of original artworks and created by the artist as listed. You must not use, reproduce, modify or distribute any images on this site or any part of those images in any manner, whatsoever. Copyright, Designs and Patents Act 1988 applies.

ARTIST ('SELLER') - TERMS and CONDITIONS

This agreement is a legal document which sets out your rights and obligations, in relation to the services offered by us through Rogue Gene Gallery, owned and operated by Andrea Pannell and Robert Kirbyson.

Rogue Gene Gallery reserves the right to change these terms and conditions from time to time. Changes will be displayed on the Rogue Gene Gallery website and will have immediate effect. The 'artist', from here on, also known as the 'seller',  will also receive notification of the changes by email.

Inclusion
The owners will select artists for inclusion in Rogue Gene Gallery themselves and discourage unsolicited applications. We intend to run a streamlined gallery of limited size, concentrating on what we consider to be work that will compliment the overall content and aims of the gallery. The artist ('seller') has no contract with the owners or Rogue Gene Gallery and as such there is no defined duration of an artists gallery.
 
Fees
There are no membership fees payable to Rogue Gene Gallery and no commission on sales. Rogue Gene Gallery receive no payment from artists. Any dialogue or transaction will be between the buyer and the artist and not Rogue Gene Gallery or its owners. Delivery and insurance charges, method and times will be settled between the buyer and the artist. The artist agrees to refund the buyer the full cost of the artwork on return, within 14 days if the buyer is dissatisfied with their purchase for any reason. Rogue Gene Ltd are not liable for the condition of any work sent by the artist or transported by carrier. Rogue Gene Gallery are not liable for the loss of any artist’s artwork before, during, or after a transaction or exhibition sponsored by Rogue Gene Gallery or its owners.

Artwork
The artist will be given a maximum of twelve spaces to display artwork. The artist must own copyright to the displayed work or have written consent from any other copyright owner to display the work in the case of collaborative works. The artist will not display work with consent, entirely by a third party. The artist will display at least six images. All descriptive fields must be filled in accurately by the artist. Rogue Gene Gallery reserve the right to remove images which offend public decency, possibly plagiarise other’s work, bring Rogue Gene Gallery into disrepute, or do not meet the quality described in the Exhibitor Information. All works (images) are displayed at the artist’s own risk.

By loading artwork (images) onto Rogue Gene Gallery, the artist agrees that Rogue Gene Gallery may use these images during promotion and advertising anywhere in the world. Rogue Gene reserve the right to edit an artists gallery text content to correct typographical errors. The works (images) displayed on Rogue Gene Gallery are non exclusive and can be displayed elsewhere. All works on display must be offered for sale to most worldwide destinations. The artist’s gallery will contain only one generic form of work, ie. just paintings or photography or sculpture, not a mixture of sculpture, paintings, photography etc. Rogue Gene reserve the right to close any artist’s gallery at any time without prior notice or reason.

Returns and Refunds
In accordance with Rogue Gene Gallery's 14 day refund policy, the artist is required to agree to the following whilst exhibiting their work on this website:  If your buyer is not completely happy with the purchase he/she has made, for whatever reason, then they may return the artwork in original condition to you, the artist concerned, within 14 days of receiving the work for a refund on the price of the item. Return delivery costs will not be refunded. You are not legally entitled to refund an item which has been created specially for the buyer such as a personalised commission.

Damaged/Lost Artworks
The above is Rogue Gene Gallery's standard returns and refunds policy in situations where the buyer is unhappy with his/her delivered artwork from the artist. In the rare case of lost or damaged artworks, the artist is advised to liaise with the buyer and carrier concerned, making an appropriate claim against the carrier that will resolve the matter to the buyers satisfaction as soon as possible.

These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
